Alex Gutierrez, candidate for Tulare City Council District 2, has been accused of assault by Democratic Central Committee (TCDCC) Vice Chair, Kathleen Dowling.
Dowling is also known locally as the “stocking lady” for her donations to the Rescue Mission at Christmas.
After a TCDCC meeting at Tulare’s Apple Annie’s May 25, 2017, Dowling said that Gutierrez picked up a chair as she was trying to leave and pinned her to the wall. She said that the legs of the chair were on either side of her so she could not move.
“He kept yelling at me ‘we need to talk, we need to talk,’ and I said, ‘no you need to let me go.’”
Starting to fear what he would do next and trying to de-escalate the situation, she said she kept her voice down and continued to encourage him to let her go because he was visibly agitated.
Gutierrez was upset about something Dowling said earlier in the evening and he wanted to talk it out before she left.
Dowling said the standoff lasted about a minute as she kept pushing against the chair telling Gutierrez, “You need to stop. I am not going to talk with you right now.” She continued, “I finally had enough adrenaline going that I pushed the chair away and started to leave. I then felt his foot push against my ankles and I hit the floor so hard that the room of 25 to 30 people became dead silent.”
TCDCC member Alberto Aguilar was standing behind her and helped her up. Another member went to get her ice for her knees. Dowling said she fell flat on her face and sustained several injuries, including bruises up and down her body and a torn rotator cuff.
Dowling assumed after the incident that the TCDCC was going to file a police report. When, after three weeks they did not, she filed a police report and notified the state Democratic Party.
Dowling and Aguilar expected TCDCC Chair Ruth McKee to call a special executive board meeting and remove Gutierrez as treasurer as per the TCDCC bylaws. Instead, Dowling was relieved of her duty as cosigner of committee checks “in an effort to lighten her load and keep her safe.”
The Tulare Police Department (TPD) conducted an investigation that came back inconclusive. Though the report was not available at press time, both Dowling and Gutierrez agreed that the TPD report revealed that as many witnesses said that an assault took place as said did not.
Dowling has until May of 2019 to formally press charges.
Gutierrez does not deny there was an incident but denies he tripped her.
He said that Dowling had been rude to him before the meeting and he wanted to tell her he didn’t appreciate what she said. He acknowledged that Dowling did not want to talk so he slid one of the restaurant’s overstuffed chairs in front of her. “But it wasn’t touching her,” he said.
Gutierrez said, “She moved the chair away and pushed herself through me and then she tripped because she walks with a wobble.”
Gutierrez said that she stepped on his foot and that is why she fell down. He also said that it was not Aguilar that helped her up but that it was him.
Because it was after the meeting many of the members were still mingling in and outside the conference room and did not witness the incident. Aguilar was a witness and sent his testimony to McKee in an email the next day.
“I witnessed an incident involving Alex Gutierrez and Kathleen Dowling that resulted in Kathleen falling to the floor due to the actions taken by Alex when he tried to block her from leaving the room where the meeting was held. I saw Alex pull a chair away from the table in his attempt to block her from exiting the room and I heard Kathleen telling Alex to stop that she didn’t want to talk to hm. Alex persisted with his attempt to bloc her from leaving which caused Kathleen to fall face first to the floor.
He continued, “When someone tells you to stop what you are doing, for whatever reason, they are putting you on notice that your behavior is not welcomed.”
Aguilar also suggested that McKee call a special executive board meeting to address Gutierrez’ behavior, writing “This is a very serious matter that requires immediate attention.”
McKee did conduct an investigation into the incident but did not call a special executive board meeting.
TCDCC member, Edith LaVonne, was a witness and said that she saw Dowling try to move the chair as Gutierrez pinned her against the wall. “Two things were very obvious, Ms. Dowling was frightened and wanted to escape being restrained.”
Gutierrez has been accused of similar outbursts by several members of the Tulare County Democrats. He also has a police record of drug and alcohol offenses and resisting arrest that would indicate anger management issues.
Gutierrez said he is a recovering alcoholic but has been sober four years this October.
He attributes his past addiction to his DUIs and the reason behind his resisting arrest. Gutierrez said that the resisting arrest charge was not a result of anger management issues, but the fact that he was still drunk when the police showed up at his house at 7am. The TPD arrived at his house because Gutierrez had missed his court date for a DUI. He admits he was uncooperative and verbally abusive to the police and opted to spend 30 days in jail instead of letting his mom bail him out and incur the court costs.
He said his time in jail was a life-changing experience. Out of the 11 people with whom he shared a cell, 10 were addicts.
“I have witnessed the most downtrodden in our community who feel no hope, and my being one of them, I realized that we need to be uplifting and show love and compassion to solve the issues facing Tulare right now.”
But it wasn’t jail that convinced him to stop drinking. He continued going to bars after his release and woke up one morning in his bed in a pool of blood. The night before he fell backward off a bar stool and cracked his head open on the cement. Because everyone was just used to seeing “drunk Alex” no one called an ambulance but called his brother to pick him up and take him home.
The next morning an injured Gutierrez said he could hear his mother cooking breakfast and his brothers chatting at the table. He realized he could have died that night in bed and no one would have known. That’s when Gutierrez decided to get sober.
“When you choose not to live like that anymore the possibilities are endless. I choose to give back all my recovery to my community.”
According to the former regional director of the State Democratic Party, who did not want to use his name, Gutierrez’ anger issues did not disappear with his sobriety. He said he has witnessed Gutierrez “blow up” at least four times.
“It’s pretty common knowledge among local Tulare Democrats,” he said.
The former director was the target of one of Gutierrez’ outbursts. “My arms were loaded with stuff and he walked right into me and it all falls down. He then blew up and started yelling at me. Five minutes later he acts like nothing happened, totally oblivious.”
“I don’t think he recognizes it,” the former director added. “He just blows up and starts screaming at someone for no real reason or something small.”
Gutierrez and Aguilar, on the other hand, believe that Dowling’s accusations and collecting testimonies from fellow Tulare County Democratic leaders are politically motivated. Though Aguilar saw the incident, he attributes it to Gutierrez’ acting childish.
Both have heard Dowling say that she would do anything she could to derail Gutierrez’ election to the city council.
As for the incident, Gutierrez admits it was silly, stupid, and childish for him to do and “it caused something unfortunate to happen.”
“It’s like a live, life, learn situation and I will never do it again,” he said.
I feel someone that is in recovery deserves another chance at life. People do many things when they are in an addiction. But the fortunate ones to rise out of an addiction should not ever be put down from there past. If we were to put everyone down from there past how could we become better people today? Yes, mistakes were made but we need to see what is produced by a person today. Alex donates so much time and sweat equity to his community. I feel he is an outstanding person if not a stronger person because of his trials and tribulations that he has gone through. He is exactly what our community needs. Someone that is familiar with struggle and is not afraid to address or meet it head on.
I do however feel that at this time the allegations made by Kathleen are politically motivated. She has done multiple attacks on Alex with this story. I know Kathleen herself and she is not a pleasant woman to work with. Not that I am justifying what transpired, I just would not put it past her to embellish this scenario. Proof is that nothing has come of it with law enforcement.
Hello Alex, we know this is you trying to clean it up. Not sure what your anger is against woman, but do yourself a favor and get out of the running. You need some serious help.
So he tried to fight Carlton Jones and acted like a victim then attacks a women at a meeting and says this is politically motivated. Come on you dang always be the victim.
Not to mention an altercation at a hospital board meeting a couple of years ago. I truly think that he demonstrates these same outbursts with friends and family. Yes you deserve a second chance I. Life with your alcoholism and thank God daily you only had a DUI as you could have taken an inocente life when you drove drunk. What kind of friends do you hang out with that tolerates your idiocy. But Alex have you sought therapy for your anger problems and do you still go to AA meetings? You have to. Physically blocking someone’s path so they cannot leave is more than merely childish, it is aggressive and inappropriate.
Is it too much to ask that our public officials and candidates for public office keep their hands to themselves and refrain from being physically aggressive towards people they disagree with?
Infighting is the last thing the local democratic party needs at the moment; all members should condemn Alex Gutierrez for this incident.

Neither Jones or Gutierrez has the much needed emotional temperament to be on a city council. Can’t do too much about Jones except to vote him out on his next re-election (that is if he decides to run again) but District 2 voters can make the decision not to vote for Gutierrez or better yet convince him to drop his bid for a seat on the city council.

This is the author. I do not believe that Concerned Community Member is Alex. Alex writes better. He was sober for two years and was not in an addiction at the time of the incident.His mother does not bail him out. that’s why he ended up in jail. He does not have a record of hitting woman and has no problem with women. If the allegations are true, he loses his temper with men and women.

Concerned Community Member is myself! Carlos Mendoza! And I stand by my words, Alex is an upstanding person. I know from personal experience that he has changed his life for the best. I can’t tell you how much he is involved with this community. He is constantly going out of his way to help those that need it. He has helped me many times. He truly has been a huge inspiration in my life. I feel it’s a shame that we knock someone down for trying to do better. What transpired with him and this woman happened a year ago. Again, nothing has come about it. I hope and pray that people will see through these allegations.
I commend you for stepping up and taking ownership of your post. I also commend Gutierrez for his turning his life around and for his work in this community…..which I hope he continues to do. More than likely sitting on Tulare’s city council will stifle his ability to continue his good works….politics can muck up so much of everything. Now might be a good time to re-evaluate just what you are really wanting to accomplish on behalf of your fellow man. You will more than likely get more accomplished with your one-on-ones and inspiring others than trying to be politically correct or in making the stressful compromises that one has to make while on that council. Not everyone has the personal temperament to be on a city council. You only have to look no further than Jones for validation of that fact.

Take off the blinders in regards to Carlton. He is the biggest bully around and not mister ethical either. He is a womanizer and he doesn’t pay his bills. He has judgments against him and has been a recent cheater in his marriage. He has inappropriately used his elected position in spending and doesn’t think rules apply to him. Just ask the outlet mall. He is in constant arguments on social media with constituents.
Watch the video of Alex trying to ask him about signing a letter after a council meeting. Notice who was the aggressor and how Mr. Epps steered Carlton away once you could see his body language become aggressive. Asking an elected official a question is a far cry from “getting in his face.”
People do not have to believe me. They can read the court documents themselves. I guess his Ex forgives him. I think the operative word here is Ex. I do not know Mr. Jones personally so I don’t know him well enough to hate him.

I commend and support Mr Gutierrez’s sobriety, however sobriety is a journey and his outbursts are an indication that he is still suffering from lack of self control. I witnessed his aggressive verbal and confrontational attacks at a TLHCD Board meeting where he was attacking employees who hadn’t gotten paid. Police were called there too. Mr Gutierrez, please pull out of the race, you are not ready to assume the role of a Councilperson, stress can be a trigger for relapse, wouldn’t want to see anyone take a step backwards. Get you emotions under control, keep working hard for the voiceless, but do it at your pace for the benefit of all.
I want to take the time to describe the Alex I know. I got to know him when he got involved with the Citizens for Hospital Accountabilty. He came to our meetings with the desire to help the hospital. He became very active in our group and became a student of all that was going on.
He played an instrumental role in collecting a very large majority of the signatures that allowed for Dr. Kumar to be recalled. He has a passion about right and wrong.
I got to know him well. Long ago he shared his past with me and was concerned that he would never be able to serve his community as a city council member. I told him to rise above it. There will always be people that want to pull you down.
He has a very good soul, an eager soul. Someone that takes the time to research and do what is best. He has a fiscal conservative nature, which is an area that we have common ground.
I don’t know the facts of this situation and I hope there is further clarity. Why is this coming out now 15 months later? Hopefully more details will be forthcoming.
After going through the nasty campaign I can see a similar pattern and even some of the same commenters. I was also at the board meeting and saw a completely different version. His family and Alex have been targeted on more than one occasion. Including making fun of his employment. Anyone that knows Alex can see he is super friendly and a very hard worker at La Piazza.
Alex didn’t relapse when his home was burned twice in a day a few days before the recall election. He is very comfortable and confident in his sobriety.
I believe he will make an excellent council member because he cares about city issues and he researches those issues. Unlike many on the council currently, past board supporters and the HCCA cheerleaders he recogonized the issues that have caused the largest investigation in the Tulare County DA’s office.
It would be great if you would demonstrate you stilll care that the Hospital Board not be populated by corrupt members doing corrupt acts to get management contracts in place.
In particular, the election in 6 weeks to place Adventist at the helm is a sham. Both the Board and Adventist are actively campaigning for this, but the contract does not exist in any final form for the public to review.

I absolutely do not support it. I have made it clear that we need transparency and it doesn’t matter to me who is in those board seats. I can assure you if I can’t be satisfied with the answers to my questions I will be a no vote.
I want the hospital open just like everyone else does but I know the challenges the District is facing and the burning desire to open it without viable planning is a sure plan for failure. This isn’t about this year, this is about long term viability for the better good of the District.

My information came from an email dated May 26, 2017 at 8:54pm sent from Alberto to Ruth McKee, Subject: Executive Board Meeting RE: Incident at TCCC Meeting at Apple Annie’s. In the email Alberto states,

I will be very disappointed if his opponent is involved in this smear campaign. This young man is more civic minded than any Tularean I know and puts in the time.

His opponent, Terry Sayre, does not know Alex enough to even make a comment and was unaware of the incident.
It seems to me that it is obvious that the person who was injured here did attempt to raise the issue to the Chair of the Democratic Central Community- and that she elected to not do ANYTHING to investigate it. The person injured didn’t wait 15 months to bring this up- she is bringing it up AGAIN now because Alex seems clearly unqualified to be placed in a position like this- where he could act as aggressively to MORE PEOPLE. I’m sure most Tulare residents would agree that when a person with a history of alcohol abuse, and convictions for irresponsible dangerous behavior such as driving when intoxicated- repeatedly, along with other examples of being “high strung” and aggressive, would not be a good candidate for a role to lead his community and resolve the conflicts that naturally come to the City Council- right?

Everyone hold up their hand if they think this is an example of the best candidate that Tulare can come up with for a position on the City Council-
Alex should not have blocked her with that chair ! He was wrong and he admitted that . He says he will never do it again .I do not want my comments to be taken as political . I do not have a dog in the city Council election fight . I live outside of the city council districts and I’m staying neutral.
Alex and I disagree on party politics and even have had friendly arguments but we are still friends .
While I believe Alex deserves criticism of this issue I also feel the need to express what I know about him . He is not a violent person. He overcame his addiction and is now a good example for others struggling with addiction. He is a good father to his son ! Alex is an ethical person . He comes from a great family. The Gutierrez family are awesome people. His Mother Senovia is a caring and ethical role model.
I agree with what Deanne Martin Soares said about Alex regarding his work on the hospital. The people of Tulare own Alex a big thank you for his work to Recall Kumar and get Senovia elected. Senovia getting on the hospital board was a pivotal moment that changed the course and saved the hospital from Benzeevi who was intent to close it down for good . Alex paid the price for his work on the Recall election. His apartment caught fire and he lost everything. I still am very suspicious of what caused that fire . Alex had his car the garage with all the Recall signs in it and that’s where the fire started.
The story about him having a issue some women after a Hospital Board meeting is something I can speak to . I was standing right next to Alex when a group of women walked up to him and verbally attack him . Alex argued back just like anyone else would . I saw a woman go get the security guard and point at Alex . I thought that was uncalled for . Alex didn’t do anything wrong and in fact he was the one attacked . Someone said he had the police called on him as if it proves Alex was in the wrong but that is a lie .
Someone also commented about the incident with Carlton Jones as if Alex was responsible. The Video clearly shows CJ as a bully and aggressor , Willard had to pull CJ away while Alex stood there doing nothing wrong . I believe in calling a spade a spade. I will not make excuses for Alex for this incident in fact I have said he was wrong but I will not kept silent and watch people lie about him and misrepresent who he is . Alex is a good hearted caring person. As for Terry Sayer using this to smear Alex , people should know that Terry is not a part of this and would never participate in a smear tactic . She is a very positive driven person and an exceptional Human being and yes I’m talking good about both to maintain my neutrality while defending the truth about Alex .

Please go back and re-read Avila’s post. He stated that Gutierrez deserved criticism on his behavior at Apple Annie’s. The jokes on you , that meeting showed everyone who you really are , 300 people showed up to the City Council meeting mostly because of watching the video of your meeting . Wes is a good man and everyone knows that you made a deal with Carlini to fire Wes . Carlini got caught again and the council had to let him go . You made a deal with Carlini to get his 9 months pay . You told Carlini that if he didn’t fire Wes then Carlini would get fired with out any pay . It is obvious by the fact that Wes gets fired and then Carlini gets fired a few hours later . The people in this town can see the truth . Just like everyone knows GottoLoveit isn’t your brother it’s really you . You keep saying the City Council doesn’t hire or fire the Police Chief but didn’t you vote to fire Carlini with 9 months pay ? That’s exactly what you did . You manipulated Wes getting fired to protect yourself from an investigation. I also heard the City employees Cheered when you got voted out as mayor .

Carlton Jones (aka GottaLoveIt) likes people to believe that he knows most everything even though in reality he knows very little if anything of real substance. He, like most narcissistic types, believes that “truth” is whatever he says it is. When challenged he gets rude and hostile and like most bullies he resorts to belittling those who think differently. He believes he has an absolute right to his own alternative facts and will move the earth to force feed those facts to all who will listen through social media or public forums.
The day I met Alex at the senior citizen center about a month ago, he admitted about his past issues and I really believe that he’s the best candidate to represent our district. He seemed very honest and also everyone that knows him in neighborhood talks very highly of him. I’m not here to judge his past or throw the first stone. I just want some one that really would be our spokesperson on our issues living on our side of town.
I look forward to the day that everyone who sits on Tulare’s city council speaks and behaves professionally. This is embarrassing. Just a reminder …High school is over.
